    Acceptable Use Policy

    This Acceptable Use Policy (the “AUP”) governs your use of the Services provided by Harmoney Financial Technologies, Inc. (“Harmoney”). It is incorporated by reference into the Harmoney Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service. Violation of this AUP may result in immediate suspension or termination of your access to the Services, forfeiture of platform balances, referral to Stripe, Plaid, card networks, or law enforcement, and civil or criminal liability.

    1. GENERAL PROHIBITIONS

    You may not use the Services to:

    • (a) engage in any illegal, fraudulent, deceptive, or infringing activity, under U.S. federal law, applicable state law, or the law of any jurisdiction in which you or your counterparty is located;
    • (b) misrepresent your identity, business, product, or transaction, including the nature or purpose of any payment;
    • (c) evade or attempt to evade currency-transaction reporting, sanctions screening, or beneficial-ownership disclosure;
    • (d) interfere with, disrupt, or compromise the security or integrity of the Services or any user’s use of them;
    • (e) transmit malware, spyware, or other malicious code;
    • (f) engage in denial-of-service attacks, credential stuffing, or unauthorized access to systems or accounts;
    • (g) scrape or harvest data other than through documented APIs used consistently with their published terms;
    • (h) reverse-engineer, decompile, or extract source code from the Services except to the extent permitted by non-waivable law;
    • (i) resell, sublicense, or white-label the Services without a written agreement; or
    • (j) use the Services in violation of any Harmoney partner’s terms, including the Stripe Restricted Businesses list, Stripe Services Agreement, or Plaid End User Services Agreement.

    2. PROHIBITED BUSINESSES AND ACTIVITIES

    You may not use the Services to accept, process, initiate, or route payments in connection with any of the following. This list is not exhaustive; where our partners (particularly Stripe) prohibit a category, we do too.

    2.1 Financial and legal restrictions

    • Money transmission or money services businesses that are not appropriately licensed;
    • Unlicensed sale of insurance, securities, or investment advice;
    • Ponzi, pyramid, matrix, or “get rich quick” schemes;
    • Multi-level marketing that operates as an unlawful pyramid;
    • Debt collection or debt-consolidation services that do not comply with the Fair Debt Collection Practices Act;
    • Credit repair, credit-restoration, or credit-counseling services that do not comply with the Credit Repair Organizations Act;
    • Payday lending, high-cost consumer lending, or lending in violation of state usury laws;
    • Cryptocurrency exchange, mining pool operation, or ICO/token issuance except through Harmoney’s designated Crypto Rail integrations when generally available;
    • Shell banks or transactions on behalf of shell banks.

    2.2 Regulated goods and services

    • Sale of firearms, ammunition, or firearm accessories except by federally licensed dealers meeting all Stripe and card-network requirements;
    • Sale of controlled substances, prescription drugs, or pharmaceuticals without appropriate licensure;
    • Sale of cannabis, marijuana, or cannabis-derived products (including CBD) except within a compliant program approved by Harmoney in writing;
    • Sale of tobacco, e-cigarettes, or vaping products to jurisdictions where prohibited or without age verification;
    • Sale of alcohol without appropriate licensure and age verification;
    • Sale of counterfeit, stolen, or gray-market goods;
    • Sale of items infringing third-party intellectual property.

    2.3 Gambling and adult content

    • Unlicensed gambling, sports betting, or games of chance for real money;
    • Skill-based contests where prohibited by law;
    • Adult content, sexually explicit material, or sexual services;
    • Escort services or dating services with sexual components.

    2.4 Fraud, misrepresentation, and abuse

    • Sale of goods or services you do not intend to deliver;
    • Sale of goods or services with materially misleading descriptions, pricing, or quality;
    • Card testing, transaction laundering, factoring, or aggregation of unrelated third-party transactions;
    • Use of stolen, unauthorized, or synthetic identities or payment credentials;
    • Structuring of transactions to avoid reporting thresholds;
    • Bribery, kickbacks, or facilitation payments in violation of the Foreign Corrupt Practices Act, UK Bribery Act, or similar law.

    2.5 Sanctions, terrorism, and prohibited jurisdictions

    • Transactions with persons on the OFAC Specially Designated Nationals List, other U.S. sanctions lists, or comparable lists of the United Nations, EU, or UK;
    • Transactions originating in or destined for comprehensively sanctioned jurisdictions (currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine), except as expressly authorized by OFAC general or specific license;
    • Financing or support of terrorism, weapons of mass destruction, or human trafficking;
    • Purchase or sale of arms, munitions, or defense articles other than through appropriately licensed channels.

    2.6 Hate, violence, and exploitation

    • Content, goods, or services that promote hatred, violence, or discrimination against protected classes;
    • Content depicting or facilitating child sexual abuse or exploitation of minors;
    • Content depicting or facilitating non-consensual acts;
    • Doxxing, harassment, or stalking.

    3. HIGH-RISK CATEGORIES REQUIRING PRE-APPROVAL

    Certain categories may be permitted only with prior written approval from Harmoney and satisfaction of enhanced due-diligence requirements. Attempting to onboard under one of these categories without approval is a violation of this AUP. Examples include:

    • Nutraceuticals, dietary supplements, and health products;
    • Subscription boxes and continuity-billing merchants;
    • Crowdfunding platforms;
    • Ticket resale and secondary-market sales;
    • Travel aggregators and non-IATA travel merchants;
    • Cryptocurrency-adjacent services (wallets, on-ramps, NFTs);
    • Political fundraising and PACs;
    • Charitable and nonprofit organizations processing high volumes. To request pre-approval, contact info@inharmoney.xyz.

    4. TECHNICAL AND SECURITY REQUIREMENTS

    You shall:

    • (a) protect account credentials and API keys and not share them;
    • (b) rotate API keys promptly upon suspected compromise;
    • (c) implement reasonable security controls (encryption in transit, secure storage of tokens, principle of least privilege) commensurate with the sensitivity of the data you process;
    • (d) maintain compliance with PCI DSS to the extent applicable to your integration model (most Harmoney integrations avoid direct PCI scope by tokenizing card data through Stripe; if you diverge from that model, you assume PCI responsibility);
    • (e) promptly report suspected security incidents affecting Harmoney data to support@inharmoney.xyz; and
    • (f) cooperate with Harmoney investigations into suspected AUP violations or incidents.

    5. COMMUNICATION AND MARKETING RULES

    You shall not use the Services to:

    • (a) send spam or bulk unsolicited commercial email in violation of CAN-SPAM;
    • (b) send SMS/text messages in violation of the Telephone Consumer Protection Act (TCPA) or applicable state analogs (including without prior express written consent where required);
    • (c) make robocalls or use automatic telephone dialing systems in violation of law;
    • (d) misrepresent your affiliation with Harmoney, Stripe, Plaid, or any bank or card network.

    6. ENFORCEMENT

    6.1 Monitoring.

    Harmoney may (but is not obligated to) monitor use of the Services for AUP compliance, including through automated screening, transaction analytics, and manual review.

    6.2 Remedies.

    Where we determine, in our reasonable discretion, that a violation has occurred or is likely to occur, we may:

    • (a) issue a warning;
    • (b) require corrective action within a specified period;
    • (c) restrict, suspend, or terminate access to the Services;
    • (d) hold, freeze, or reverse platform balances or payouts;
    • (e) report the activity to Stripe, Plaid, card networks, law enforcement, or regulators;
    • (f) pursue civil damages, indemnification, or injunctive relief. Remedies are cumulative and not exclusive. Nothing in this AUP requires Harmoney to give notice or opportunity to cure before acting, particularly where legal, regulatory, or partner obligations require immediate action.

    7. REPORTING VIOLATIONS

    8. CHANGES

    Harmoney may update this AUP at any time. Material changes will be posted at inharmoney.xyz/aup with a revised “Last Updated” date and, where required, communicated by email or in-app notice.
