Electronic Communications & E-SIGN Consent

This Electronic Communications and E-SIGN Consent (the “E-SIGN Consent”) applies to any communication, agreement, disclosure, notice, statement, record, or other document (each, a “Communication”) that Harmoney Financial Technologies, Inc. (“Harmoney”), or its financial-services partners including Stripe and Plaid, provides to you or that you sign, agree to, or submit in connection with the Services. Under the federal Electronic Signatures in Global and National Commerce Act (the “E-SIGN Act”) and applicable state law, we are required to obtain your consent to receive Communications electronically and to conduct business with you using electronic signatures. Please read this E-SIGN Consent carefully and keep a copy for your records.
1. YOUR CONSENT
By clicking “I Agree,” creating an account, activating a TapCard, initiating a transaction, or otherwise using the Services, you affirmatively consent to:
- (a) receive all Communications from Harmoney and its financial-services partners electronically;
- (b) sign agreements, authorizations, and disclosures electronically; and
- (c) transact with Harmoney and its partners using electronic records and electronic signatures. Your electronic signature has the same legal effect as a handwritten signature.
2. SCOPE OF COMMUNICATIONS
Electronic Communications may include, without limitation:
- These Terms of Service, Privacy Policy, Acceptable Use Policy, and this E-SIGN Consent, and any updates to them;
- Account-opening and identity-verification (KYC/KYB) disclosures;
- Payment authorizations, including one-time and recurring ACH authorizations (Nacha rules);
- Transaction receipts, confirmations, and history;
- Chargeback, refund, and dispute notices;
- Fee schedules and changes;
- Notices required under GLBA, Regulation E, Regulation P, Regulation Z (as applicable), state financial-privacy laws, and other law;
- Tax forms, including IRS Form 1099-K where applicable;
- Legal notices, subpoenas responses (where legally permissible), and communications relating to security incidents;
- Product updates, service alerts, and (where consent is otherwise given) marketing.
3. HOW WE DELIVER COMMUNICATIONS
We may deliver Communications by:
- (a) posting them to your Harmoney account dashboard or in the Harmoney application;
- (b) sending them to the email address or mobile number associated with your account;
- (c) posting them to inharmoney.xyz;
- (d) push notification through the mobile application; or
- (e) any other reasonable electronic means. You are responsible for ensuring your contact information is current. Communications are deemed delivered when sent by us, regardless of whether you actually access them.
4. HARDWARE AND SOFTWARE REQUIREMENTS
To access and retain electronic Communications, you need:
- A computer or mobile device with an operating system capable of running a modern web browser (current versions of Chrome, Safari, Firefox, or Edge);
- Internet access;
- A valid email address you can access;
- Sufficient storage or the ability to print or download PDF files;
- A PDF reader (e.g., Adobe Acrobat Reader or equivalent). Certain features may require the Harmoney mobile application. If our system requirements change materially in a way that could affect your ability to access Communications, we will notify you and give you an opportunity to withdraw consent without penalty.
5. PAPER COPIES
You may request a paper copy of any Communication by contacting support@inharmoney.xyz. We may charge a reasonable fee for paper copies unless prohibited by law. Requesting a paper copy does not withdraw your consent to receive Communications electronically.
6. WITHDRAWING CONSENT
You may withdraw your E-SIGN Consent at any time by emailing support@inharmoney.xyz with the subject line “Withdraw E-SIGN Consent.” Withdrawal is effective only after we have had a reasonable period to process it. Because the Services are provided electronically, withdrawal of E-SIGN Consent will result in termination of your account and Services. You will remain responsible for any obligations incurred prior to termination.
7. UPDATING YOUR CONTACT INFORMATION
Keep your email, mobile number, and mailing address current in your account settings. You are responsible for consequences of failing to update your contact information, including missed Communications.
8. ACH AND PAYMENT AUTHORIZATIONS
Where you authorize an ACH debit, card transaction, or other electronic funds transfer through the Services, your electronic signature constitutes your written authorization for purposes of Nacha rules, Regulation E (12 C.F.R. Part 1005), and applicable card-network rules. Specific authorization terms are presented at the time of the transaction and are incorporated by reference.
9. CONSENT TO CONTACT
You consent to receive calls, SMS/MMS messages, and other electronic communications from Harmoney and its service providers at the phone number and email address associated with your account, including messages sent using automated systems or prerecorded voice, for account, transaction, fraud, servicing, and (where separately consented) marketing purposes. Message and data rates may apply. You may opt out of marketing messages at any time by following the unsubscribe instructions in the message or contacting support@inharmoney.xyz. Opting out of marketing does not affect transactional or servicing communications required to operate your account.
10. RECORDKEEPING
We recommend that you download and retain a copy of this E-SIGN Consent and any other Communications for your records.
11. AFFIRMATION BY PROCEEDING, YOU AFFIRM THAT YOU:
- (a) can access, view, and retain electronic Communications in the formats provided;
- (b) have read and understand this E-SIGN Consent;
- (c) consent to receive all Communications electronically and to use electronic signatures; and
- (d) are legally authorized to give this consent, including on behalf of any business entity for which you are acting.
